BY USING THE SITE, YOU ACCEPT AND AGREE TO THESE TERMS AND CONDITIONS AS APPLIED TO YOUR USE OF THE SITE. If you do not agree to these Terms of Use, you may not access or otherwise use the Site.
As between you and the Anthology, Anthology owns, controls, or licenses all rights, title and interest in and to the Site, all the content (including, for example, audio, photographs, illustrations, graphics, other visuals, video, copy, software, etc.), code, data and materials thereon, the look and feel, design and organization of the Site, and the compilation of the content, code, data and materials on the Site, including but not limited to any copyrights, trademark rights, patent rights, database rights, moral rights, sui generis rights and other intellectual property and proprietary rights therein. Your use of the Site does not grant to you ownership of any content, code, data or materials you may access on the Site. You may view the content on the Site on your computer or other Internet compatible device, and make single copies or prints of the content on the Site for your personal, internal use only. The Site and the services offered on or through the Site, including any content and materials thereon, are only for your personal, non-commercial use. Any commercial distribution, publishing or exploitation of the Site, or any content, code, data or materials on the Site, is strictly prohibited unless you have received the express prior written permission of Anthology or the applicable rights holder. Any use of the Site, or the content, code, data or materials thereon, except as otherwise provided herein, is strictly prohibited. We will enforce our intellectual property rights to the fullest extent of the law.
Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of Anthology or the third party that may own the applicable Trademark. Your misuse of the Trademarks displayed on the Site is strictly prohibited. We will enforce our Trademark rights to the fullest extent of the law.
(a) You may browse the Site without registering, but you understand that some features of the Site may not be accessible to you unless you register. In registering for the Site, you agree to: (1) provide true, accurate, current and complete information about yourself as prompted by the Site's registration form (the "Registration Data"); and (2) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Anthology has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Anthology may suspend or terminate your account and deny you access to the Site.
(b) In lieu of registering for the Site, you may also log in to the Site using credentials associated with your account at third-party services (collectively, “Third-Party Service”). If you choose to log in using an account from a Third-Party Service, Anthology may: (1) have access to certain information that you make available through the Third-Party Service; (2) contact you via an e-mail address associated with your account at the Third-Party Service; and (3) post status updates, notes, photos, videos and other materials to the Third-Party Service on your behalf pursuant to the permissions that you grant. You acknowledge that all terms of use, policies and guidelines established by the Third-Party Service apply to your use of your account from that Third-Party Service to interact with the Site.
(c) You are fully responsible for all activities that occur under your account. You may not share your account or password with anyone. You agree to notify Anthology immediately of any unauthorized use of your password or account or any other breach of security.
(d) You represent that you are: (1) over the age of thirteen (13); (2) of legal age to form a binding contract; and (3) not a person barred from using the Site under the laws of the United States or any other applicable jurisdiction. If Anthology has reason to suspect that you are not in compliance with any of the foregoing, it may suspend or terminate your account and deny you access to the Site.
Anthology confers verified accounts to let users know that the verified account holder has submitted information requested by Anthology for authentication purposes, and that Anthology has reviewed and confirmed the identity appears to be authentic. However, Anthology cannot and does not guarantee that any account holder, whether verified or unverified, is the person or organization they purport to be.
Anthology plays no role in determining the value or veracity of a badge or the requirements that underlie it, and Anthology does not endorse or vouch for the qualifications of any Issuer or Earner.
You agree and acknowledge that you are solely responsible for determining the value and veracity of each badge and the qualification of each Issuer and Earner. You also accept that the organization retains the right to revoke a badge for reasons it deems defensible. Anthology in no way is responsible for exploring or validating the causes an issuer uses for revocation of an asserted badge. It is your sole responsibility to seek remedy in such cases if you believe you have cause.
You warrant and agree that you shall not: (a) impersonate any person or entity or misrepresent your affiliation with any other person or entity; (b) upload, post, publish, transmit, reproduce, distribute or in any way exploit any information or other material obtained through the Site for commercial purposes (other than as expressly permitted by the provider of such information or other material); or (c) attempt to gain unauthorized access to other computer systems through the Site. You may not: (i) engage in spidering, “screen scraping,” “database scraping,” harvesting of e-mail addresses, wireless addresses or other contact or personal information, or any other automatic means of obtaining lists of users or other information from or through the Site or the services offered on or through the Site, including without limitation any information residing on any server or database connected to the Site or the services offered on or through the Site; (ii) use the Site or the services made available on or through the Site in any manner with the intent to interrupt, damage, disable, overburden, or impair the Site or such services, including, without limitation, sending mass unsolicited messages or “flooding” servers with requests; or (iii) use the Site or the Site’s services in violation of any applicable law. You agree that if you include a link from any other web site to the Site, such link shall open in a new browser window. You agree not to link from any other web site to this Site in any manner such that the Site, or any page of the Site, is “framed,” surrounded or obfuscated by any third party content, materials or branding. We reserve the right to revoke your right to link to the Site from your web site at any time upon written notice to you.
You agree to defend, indemnify and hold Anthology, its subsidiaries, affiliates, directors, officers, members, managers, employees and agents harmless from any and all claims, liabilities, costs and expenses, including reasonable attorneys’ fees, arising in any way from your use of the Site, your placement or transmission of any message, content, information, software or other materials through the Site, or your breach or violation of the law or of these Terms of Use. Anthology reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with the Anthology’s defense of such claim.
We may make certain products available to visitors and registrants of the Site. You may only order products if, and you hereby represent and warrant that, you are domiciled in the United States or a designated territory to which we conduct product deliveries and you are 18 years old or older. You agree to pay in full the prices for any purchases you make either by credit/debit card concurrent with your online order or by other payment means acceptable to the Anthology. You agree to pay all applicable taxes. If payment is not received by us from your credit or debit card issuer or its agents, you agree to pay all amounts due upon demand by us. All prices displayed on the Site are quoted in U.S. dollars. Anthology may restrict delivery to addresses within the United States and Canada. Anthology will add shipping and handling fees and applicable sales/use tax as necessary. Anthology reserves the right without prior notice to discontinue or change specifications and prices on products and services offered on the Site without incurring any obligation to you. Products displayed on the Site are available while supplies last. The receipt by you of an order confirmation does not constitute the Anthology’s acceptance of an order. Prior to the Anthology’s acceptance of an order, verification of information may be required. The Terms of Use and the relationship between you and us shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. You agree that any cause of action that may arise under these Terms of Use shall be commenced and be heard in the appropriate court in the State of New York, County of New York. You agree to submit to the personal and exclusive jurisdiction of the courts located within New York County in the State of New York. Our failure to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use shall remain in full force and effect without cause.
